Texas lien filing deadline

Original contractor: by the 15th day of the fourth month after the month the work was completed, terminated or abandoned, or the third month on a residential project. Others: the 15th day of the fourth month after the month of last labor or materials, or the third month on a residential project. (Texas Property Code 53.052). A waiver does not stop this clock. See deadlines in every state.

It depends on the payment. Texas sets 4 forms: conditional waiver and release on progress payment; unconditional waiver and release on progress payment; conditional waiver and release on final payment; unconditional waiver and release on final payment. Use a conditional form when you are asking to be paid and an unconditional form only after the money has cleared, where the state makes that split.

Can I change the wording of the Texas form?

Fill in the blanks, but keep the wording. The statute expects its form, and changes can make a waiver unenforceable or give up more than you meant to. Ask an attorney before signing a version that differs.

How long do I have to file a lien in Texas?

Original contractor: by the 15th day of the fourth month after the month the work was completed, terminated or abandoned, or the third month on a residential project. Others: the 15th day of the fourth month after the month of last labor or materials, or the third month on a residential project. (Texas Property Code 53.052). Most states also have notice steps before the lien; read the statute.
